The West New York man accused of repeatedly raping his teen-age daughter and then ordering her to throw away their two babies — one to her death — will have his third opportunity to take a plea deal tomorrow morning, officials said.
Jose Ventura, 45, can't receive the death penalty, but if he doesn't accept the plea deal, "he faces more time than any man can live" — a life sentence plus 40 years, Hudson County Assistant Prosecutor Michael D'Andrea said.
D'Andrea wouldn’t say what sentence the prosecution would recommend if Ventura does accept the plea deal. He also faces deportation to his native El Salvador.
Tomorrow at 9 a.m., in the court of Hudson County Superior Court Judge Kevin Callahan, Ventura can either accept or reject the state's plea deal offer. If he turns the deal down, the trial will likely begin in the spring, D'Andrea said.
